Terms and conditions of participation

§ 1 Application – Validity

  1. The “Up The Hill” (hereinafter referred to as UTH) is an event organized by albside e.V. (hereinafter referred to as the organizer).
  2. The terms and conditions of participation are published online at www.upthehill.run. The version valid at the time of registration forms part of the contract between the organizer and the participant.

§ 2 Safety measures

  1. Participants bear full personal responsibility for their health. They must be aware of the distance and specific conditions (cold, potential snow, rain, wind, elevation gain, terrain) of the event and prepare accordingly. Participation is open to anyone who has registered properly and is in possession of an official UTH race number.
  2. Organizational measures will be communicated to participants by the organizer before the start of the event. Participants must strictly follow the instructions of the organizer and their clearly identified personnel. In the event of violations that disrupt the orderly conduct of the event or endanger the safety of other participants, the organizer is entitled to exclude the person in question from the event and/or disqualify them at any time. Legally binding statements can only be made to participants by authorized personnel of the organizer.
  3. All regulations, instructions, and guidelines contained in the event announcement and supplementary instructions constitute a direct contractual obligation for the participant. Any claims of any kind relating to the contract or the services provided by albside e.V. must be asserted by the participant against albside e.V. within one month of the contractually agreed end of the UTH (University Training Day) after the event has ended.

§ 3 Registration – Participation fee – Registration confirmation – Payment terms – Refund – Cancellation – Insurance

  1. Registration takes place online on the organizer’s website or via RaceResult. Registration is binding for the participant. After successful registration, the participant will immediately receive a confirmation email, which confirms the binding contract for participation in the event. Payment of the entry fee and any optionally booked services is due in full upon registration.
  2. The entry fees for the individual distances are listed at www.upthehill.run. The exact scope of services included with a starting place can be found on the website.
  3. The following distances are offered: UTH25, UTH10, UTH5, KidsRun (KR1500, KR1000, KR500).
  4. When registering for the KidsRun, the parent or legal guardian is responsible for supervision on-site at the event grounds. The legal guardian confirms that the registration for the KidsRun is made with their consent.
  5. The Flex Ticket can only be added when registering for the UTH25. The ticket can be redeemed once until the UTH race the following year and offers the option to choose one of the following:
    • Change the distance to a shorter course within the same year or
    • Postpone your participation by one year.
  6. None of the above options/services are available without the Flex Ticket.
  7. The Flex Ticket or a starting place cannot be transferred to another person.
  8. Requests to change to a shorter distance must be submitted in writing via email to info@upthehill.run. This option is only available as long as the respective shorter distance is not yet fully booked.
  9. Postponing your starting place to the following year is done by issuing a voucher for a starting place. The voucher code will be sent to the participant via email before registration opens for the next UTH race. This voucher only covers the starting fee for the distance originally booked and does not include any additional services.
  10. Payments can be made in three different ways:
    • SEPA Direct Debit
    • Credit Card
    • PayPal
  11. After receiving the registration and the participation fee, the organizer will send the participant a confirmation email. The organizer reserves the right to disqualify and/or exclude a participant from the event at any time if they have provided false personal information during registration, are subject to a ban by an international/national federation, or if there is suspicion that the participant is competing after using prohibited substances (doping). The organizer may exclude the participant from the event/terminate the contract with the participant if:
    • they violate the regulations and/or the rules and instructions (before or during the event).
    • they persistently disrupt the event or endanger themselves or others.
    • they fail to follow the instructions of the event management or staff.
    • they behave in such a way that immediate termination of the contract is justified.
  12. The organizer may exclude the participant from the event/terminate the contract with the participant if:
    • they violate the regulations and/or the rules and instructions (before or during the event).
    • they persistently disrupt the event or endanger themselves or others.
    • they do not follow the instructions of the event management or staff.
    • they behave in such a way that immediate termination of the contract is justified.
  13. The organizer may exclude the participant from the event/terminate the contract. If the organizer terminates the contract with the participant, he retains the right to the participation fee.

§ 4 Cancellation of the event – ​​Failure to attend

  1. In the event of cancellation of the event or individual sections of the course due to force majeure (e.g., bad weather, pandemics), or if a participant fails to appear or abandons the race for reasons beyond the organizer’s control, the participant is not entitled to a refund or partial refund of the entry fee, nor to compensation for other damages such as travel or accommodation costs.
  2. If a registered participant does not appear at the start, there is no entitlement to a refund of the entry fee.

§ 5 Disclaimer

  1. By registering, the participant commits to attending their chosen event organized by the organizer and confirms, without further verification by the organizer, that they possess the specific experience and knowledge listed in section 2 of the Terms and Conditions.
  2. The participant’s claims for damages against the organizer, regardless of the legal basis, are excluded.
  3. This exclusion does not apply if the organizer, their legal representatives, or agents have acted intentionally or with gross negligence, or if the organizer is liable for damages for which they are responsible, such as injury to life, body, or health, or breach of essential contractual obligations.
  4. The participant agrees to submit to checks ordered by the organizer.
  5. The participant fully acknowledges and accepts the terms of participation and the applicable regulations. They expressly declare that they have read, understood, and accepted all rules, regulations, and conditions contained therein.
  6. By registering, the participant declares that they participate in the event at their own risk and that they have sufficient accident insurance coverage.
  7. The organizer assumes no liability for any health risks to participants in connection with their participation in this event. By registering for the event, the participant confirms that there are no health concerns that would preclude their participation and that their physical fitness level meets the requirements of such an endurance competition. Participants are responsible for ensuring they have the necessary equipment in accordance with the regulations.
  8. The organizer assumes no liability for lost valuables, clothing, or equipment.
  9. The organizer is not liable for any reduction in performance resulting from a participant being wholly or partially prevented from participating due to legal regulations and/or official orders.
  10. If the participant or the organizer engages third parties, e.g., to contact emergency services, the resulting costs are to be borne by the participant, or the organizer reserves the right to collect any such costs from the participant.

§ 6 Data Collection and Use

  1. By registering, the participant declares that they agree that the data provided in the registration may be collected for timing, placement, and results purposes and may be shared with third parties and published online.
  2. The personal data provided by the participant during registration will be stored and processed solely for the purpose of organizing and administering the event. This applies in particular to the data necessary for payment processing (Section 28 of the German Federal Data Protection Act). By registering, the participant consents to the storage of their data for this purpose.
  3. The participant agrees that photos, videos, and interviews taken in connection with their participation in the event may be disseminated and published in radio, television, print media, books, and social media (Facebook, Instagram, the event website, the albside e.V. homepage, YouTube, etc.) without any claim to compensation. Furthermore, the participant agrees to the transfer of their personal data for the purpose of receiving photos produced by a company commissioned by the organizer. However, this does not constitute an agreement to purchase such a photo.
  4. The participant agrees that they wish to receive photos. The participant agrees to the publication of their surname, first name, year of birth, team name, bib number, and results (placements and times) in all event-related print media (participant list, results list, etc.) and in all electronic media, such as the internet.
  5. The participant may object to the disclosure and publication of their personal data by notifying the organizer in writing via email.
  6. By providing their email address, the participant agrees that the organizer may use it to send them information.

§ 7 Statute of Limitations

  1. Claims of the participant against the organizer, regardless of the legal basis, become time-barred one year after the contractually agreed end of the event.
  2. The place of jurisdiction for disputes arising from the contract concluded with the participant is Albstadt. German law applies exclusively to the entire legal and contractual relationship between the organizer and the participant.
